1. Overview

This website is operated by Liquichem Australia. Throughout these Terms, “Liquichem”, “we”, “us” and “our” refer to Liquichem Australia.

These Terms apply when you access our website, create an account, place an order or purchase products from us.

Our website is hosted by Shopify, which provides the ecommerce platform that enables us to sell our products online. All purchases made through this website are made directly with Liquichem Australia.

By using this website or placing an order, you agree to these Terms, our Returns and Refund Policy, Privacy Policy and Shipping and Delivery Policy.

Nothing in these Terms excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law.

2. Eligibility and Accounts

You must be at least 18 years old and legally capable of entering into a contract to place an order through this website.

You must provide accurate, current and complete account, billing, payment and delivery information.

You are responsible for maintaining the confidentiality of your account details and for activity conducted through your account. Please notify us promptly if you believe your account has been used without authorisation.

We may suspend or restrict an account where we reasonably suspect fraud, unlawful conduct, unauthorised access or a serious breach of these Terms.

3. Products

Liquichem supplies automotive cleaning and detailing products, chemical liquids, solvents and related accessories.

We take reasonable care to ensure product descriptions, photographs, sizes, prices and instructions are accurate. Screen settings, lighting and packaging updates may cause minor visual differences.

Product photographs are illustrative. Minor differences in colour, fragrance, viscosity or appearance between manufacturing batches do not necessarily indicate a fault where the product remains within specification and performs as represented.

We may update product packaging, descriptions or specifications where the change does not materially reduce the product’s stated function or quality.

Products may be discontinued or temporarily unavailable without notice.

4. Automotive Chemical Use

Customers must read and follow the product label, directions, recommended dilution, warnings and Safety Data Sheet where applicable.

Safety Data Sheets are available through our website or by contacting Liquichem.

Automotive surfaces, application equipment and operating conditions vary. Test the product on a small, inconspicuous area before full application where compatibility is uncertain.

Customers must not:

• Use products contrary to their directions

• Mix products unless Liquichem has confirmed compatibility

• Apply chemicals to incompatible, damaged, hot or sensitive surfaces

• Apply tyre shine to tyre tread, braking surfaces, pedals or vehicle controls

• Use flammable products near heat, sparks, flames or ignition sources

• Use solvent based products with unsuitable bottles, seals or trigger sprayers

• Dilute or decant products into an incorrectly labelled or incompatible container

Liquichem is not responsible for damage caused by misuse, incorrect dilution, improper storage, incompatible equipment or failure to follow the product directions.

This section does not limit any rights available under the Australian Consumer Law where a product fails to meet an applicable consumer guarantee.

5. Product Performance

Foam thickness, shine, cleaning performance, finish and product consumption may vary depending on:

• Dilution

• Application equipment

• Water pressure

• Water hardness

• Surface condition

• Contamination level

• Weather and temperature

• Application technique

A difference caused solely by these external conditions does not necessarily indicate that the product is faulty.

6. Orders

Submitting an order constitutes an offer to purchase products from Liquichem.

An order is accepted when we confirm acceptance or dispatch the products. An automated order acknowledgement does not necessarily constitute acceptance.

We may reasonably decline or cancel an order where:

• A product is unavailable

• Payment cannot be authorised

• Delivery cannot be safely or legally completed

• The order contains an obvious pricing or product information error

• We reasonably suspect fraud, unlawful activity or unauthorised resale

• The customer has provided incomplete or incorrect information

If we cancel an order after receiving payment, we will refund the amount paid for the cancelled products.

This website accepts orders from individual customers and businesses. Products may not be commercially resold or represented as being supplied by an authorised Liquichem distributor unless Liquichem has approved that arrangement in writing.

7. Prices and GST

All website prices are displayed in Australian dollars and include GST unless clearly stated otherwise.

Delivery and optional charges are displayed separately before checkout where applicable.

Prices may change without notice. A price change will not affect an order already accepted by Liquichem.

An obvious pricing error does not require us to supply a product at the incorrect price. If this occurs, we will contact you and provide the option to proceed at the correct price or cancel the affected product for a refund.

8. Payment

Payment must be made using an available payment method at checkout unless Liquichem has approved separate trade or credit terms.

You confirm that you are authorised to use the selected payment method and that the payment information provided is accurate.

Ownership of products does not pass to the customer until payment has been received in full.

9. Promotions and Discount Codes

Promotions and discount codes are subject to their stated conditions and expiry dates.

Unless otherwise stated:

• Only one discount code may be used per order

• Discount codes cannot be exchanged for cash

• Discounts cannot be applied retrospectively

• Promotions apply only to eligible products purchased during the promotional period

• Discount codes may be limited to one use per customer or order

We may cancel a discount or promotion where it has been used fraudulently or contrary to its published conditions.

10. Order Changes and Cancellations

Please review your order carefully before submitting it.

Contact us immediately if you need to request a change or cancellation. We may be able to assist before processing or dispatch begins, but cancellation cannot be guaranteed.

Once an order has entered processing or been dispatched, it cannot be cancelled because of a change of mind.

Custom, bulk and made to order products cannot be cancelled once manufacturing, filling, labelling or procurement has commenced, except where required by law.

11. Shipping and Delivery

Delivery timeframes are estimates and may vary depending on the destination, carrier, product size and dangerous goods requirements.

We will take reasonable steps to dispatch and deliver orders within the stated or otherwise reasonable timeframe.

If we become aware of a significant delay or cannot supply an accepted order, we will contact you and provide an appropriate solution, which may include a replacement, revised delivery arrangement or refund.

Risk in the products passes to the customer when the products are delivered to the nominated address or collected by the customer or their authorised representative.

Customers must provide a complete and accurate delivery address. Dangerous goods and bulky products cannot be delivered to a PO Box or Parcel Locker.

Some pallet and bulk deliveries may require suitable site access, a forklift, loading dock or other unloading arrangements. These requirements will be communicated where applicable.

12. Dangerous Goods

Some Liquichem products are classified as dangerous goods for transport.

Dangerous goods may only be shipped using suitable carriers and may be subject to delivery location restrictions, additional charges and longer delivery timeframes.

Customers must not request or arrange transport that would breach applicable dangerous goods requirements.

Chemical and dangerous goods products must not be returned through ordinary post or an unauthorised carrier. Contact Liquichem before returning, transporting or disposing of any chemical product.

13. Pickup Orders

Pickup is available from Wetherill Park, NSW where offered at checkout or confirmed by Liquichem.

Customers must wait for confirmation that an order is ready before attending the pickup location.

The person collecting the order may be required to provide the order confirmation and reasonable identification.

Risk passes to the customer when the order is collected by the customer or their authorised representative.

14. Returns, Refunds and Consumer Guarantees

Returns, replacements and refunds are handled in accordance with our Returns and Refund Policy.

Liquichem does not accept returns, refunds or exchanges for change of mind, including where a customer orders the wrong product or size or no longer requires the product.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

15. Trade, Wholesale and Bulk Orders

Trade, wholesale, distributor, 200L drum, 1000L IBC and custom orders may be subject to a separate written quotation, credit application, supply agreement or delivery arrangement.

Where separate written terms are accepted for a particular order, those terms apply to that order. These website Terms continue to apply to matters not addressed by the separate agreement.

Any exclusive territory, distributor status, wholesale pricing or ongoing supply arrangement must be confirmed by Liquichem in writing.

16. Reviews and Submitted Content

If you submit a review, photograph, video or other content, you confirm that:

• The content is based on your genuine experience

• You have the right to submit it

• It is not false, misleading, defamatory or unlawful

• It does not infringe another person’s rights

• Any incentive or benefit connected with the review has been disclosed

You grant Liquichem a nonexclusive, worldwide and royalty free licence to reproduce and display submitted content for website, advertising and promotional purposes.

We may remove content that is unlawful, fraudulent, abusive, misleading, unrelated, spam or infringes another person’s rights.

17. Acceptable Website Use

You must not:

• Use the website for an unlawful or fraudulent purpose

• Interfere with the website’s operation or security

• Upload malicious code

• Attempt to gain unauthorised access to accounts or systems

• Collect personal information about other users

• Impersonate another person or business

• Copy or exploit website content without permission

• Use automated systems in a manner that materially disrupts the website

We may restrict access where reasonably necessary to protect customers, Liquichem or the website.

18. Intellectual Property

The Liquichem name, logos, product names, label designs, website content, photographs, videos, graphics and other original materials are owned by or licensed to Liquichem Australia.

These materials are protected by applicable Australian intellectual property laws.

You may use the website for ordinary personal or business purchasing purposes. You must not reproduce, modify, distribute or commercially exploit our intellectual property without written permission.

19. Third Party Services and Shopify

Our website may use Shopify and other third party services for hosting, payments, shipping, analytics and website functionality.

Those providers may have their own terms and privacy policies. Liquichem is not responsible for independent third party websites or services that we do not control.

All product sales made through this website are directly between the customer and Liquichem Australia. Shopify provides the ecommerce platform and is not the seller of Liquichem products.

20. Privacy

Personal information is handled in accordance with our Privacy Policy.

Information may be processed by Shopify, payment providers, delivery carriers and other service providers where reasonably required to process orders and operate the website.

21. Website Availability

We aim to keep the website accurate, secure and available, but uninterrupted access cannot be guaranteed.

We may temporarily restrict access for maintenance, security, technical problems or matters outside our reasonable control.

This does not affect any accepted order or rights available under applicable law.

22. Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot legally be excluded.

To the extent permitted by law, neither party is liable to the other for indirect or consequential loss that was not reasonably foreseeable.

Liquichem is not responsible for loss caused by:

• Customer misuse or failure to follow product directions

• Incorrect dilution or mixing

• Use on an incompatible surface

• Improper storage or handling

• Use with unsuitable equipment

• Incorrect information supplied by the customer

• Unauthorised alteration, decanting or relabelling of a product

Where goods are not ordinarily acquired for personal, domestic or household use, and where it is fair, reasonable and legally permitted, Liquichem’s liability may be limited to replacing the goods, supplying equivalent goods, repairing the goods or paying the reasonable cost of doing so.

23. Events Outside Reasonable Control

Neither party is responsible for delay caused by an event outside its reasonable control.

The affected party must take reasonable steps to reduce the delay and communicate material impacts.

If Liquichem cannot supply an accepted order within a reasonable time, we will provide an appropriate solution, which may include cancellation and a refund for products that cannot be supplied.

24. Severability

If any part of these Terms is found to be unlawful or unenforceable, that part will be removed or limited to the minimum extent necessary. The remaining Terms will continue to operate.

25. Changes to These Terms

We may update these Terms to reflect changes to our products, website, business practices or legal obligations.

Changes apply from the date they are published and do not retrospectively alter an order already accepted unless required by law or agreed with the customer.

26. Governing Law

These Terms are governed by the laws of New South Wales and the Commonwealth of Australia.

The parties submit to the nonexclusive jurisdiction of the courts and tribunals of New South Wales and any other court or tribunal that has jurisdiction under applicable law.
